WMS must be notified in writing no later than October 30, 2009 of intention to cancel or withdraw from the exhibition. Cancellations received before October 30, 2009 will receive a full refund.
No refunds will be given after this date.
Exhibitor Rules and Regulations |
1. Exhibit shall not obstruct the view of adjoining exhibits nor operate in any manner objectionable to other exhibitors. All lighting within the exhibit must be arranged and operated without distracting from adjacent exhibits. All demonstrations shall be confined to the space allotted to each exhibitor. Activities should be planned in a manner that they will not interfere with normal traffic flow, nor infringe on normal conversations in nearby exhibits. Any exhibit consistently disturbing others may be closed.
2. No hazardous, radioactive or other dangerous materials shall be brought into the exhibit area.
3. Nothing shall be posted on, nailed, screwed, or otherwise attached to columns, walls, floors, drapes or other parts of the exhibit structure or furniture.
4. Dismantling – the exhibitor agrees not to dismantle their booth or to do any packing before the final closing hour of the exhibition which is 12:00 pm on Wednesday, March 10, 2010.
5. Security – 24 hour security personnel will be provided beginning when exhibitor freight is delivered to the exhibition floor on Friday, March 5, 2010 and will continue through 7:00 pm on Wednesday, March 10, 2010. The prudent exhibitor should not leave valuable articles unprotected.
6. WM Symposia must approve, in writing, of any assigning, subletting, or apportionment of the whole or any part of the space allotted.
7. The Exhibitor agrees to assume all risks of loss, injury, theft or damage of any kind or nature whatsoever to any exhibitor or component therefore, including any goods, merchandise, chattels, papers and business records or other property which may be in or come into the exhibitor’s possession during the course of the exhibit, or in the course of assembling or disassembling the exhibit and to assume all liability for damage to property, person or persons arising from accidental or other causes incidental to movement and operation of exhibitor and thereby releases WMS, M.Y. Events, its contractors and the Phoenix Convention Center from any liability whatsoever.
8. WM Symposia reserves the right to relocate exhibitors only if it becomes necessary. Every effort will be made to accommodate the exhibitor’s location preference. Prior notification will be given to exhibitor in order to mutually agree on a different location.
9. Exhibitor agrees to use the WM2010 attendee listing for the purposes of invitations to visit your exhibit or to attend a hospitality event only. This listing cannot be used for mass marketing.
10. All food and beverage served by exhibitor must be served under contract between the exhibitor and the Phoenix Convention Food Service Contractor. The exhibitor understands that this is a condition of use of the PhoenixConvention Center.
11. In case any part of the exhibition hall is destroyed or damaged so as to prevent WM Symposia from permitting an exhibitor to occupy assigned spaced during any part or the whole of the exhibition period, or in case occupation of assigned space during any part or the whole exhibition period is prevented by strikes, Acts of God, national emergency or other causes beyond the control of WM Symposia, then the exhibitor will be charged for space only for the period the space was or could have been occupied by exhibitor; and the exhibitor hereby waives any claim against WM Symposia, M.Y. Events, its directors, officers, agents or employees for losses or damages which may arise in consequence of such inability to occupy assigned space.
12. Exhibitor agrees to protect, indemnify and hold harmless WM Symposia, M.Y. Events, the Phoenix Convention Center and their respective officers, directors, employees and agents, against and from any all losses, costs, damages, liability or expenses including attorney’s fees and judgments arising from or by reason of any accident, bodily injury, property damage or other claims or occurrences to any person, including Exhibitor, its employees and agents, or any business invites, arising out of or related to Exhibitor’s occupancy or use of the exhibit premises in the show or on and adjacent to the Phoenix Convention Center including storage and parking areas or any claims arising out of or related to exhibiting.
13. Exhibitor understands that WM Symposia, M.Y. Events and the PhoenixConvention Center do not maintain insurance covering Exhibitor’s property, damage or loss as well as injury to persons assembling or dismantling exhibit and that it is the sole responsibility of exhibitor to maintain such insurance. Exhibitor shall maintain general liability insurance in an amount not less than One Million Dollars ($1,000,000) to cover its potential liabilities under this Agreement, and shall name WMS as an additional insured under Exhibitor’s liability policy for the period of this Show including move-in and move-out periods.
14. Exhibitor represents and warrants that its exhibit and product/service information shall comply with the Americans with Disabilities Act, its regulations and guidelines (collectively “ADA”). Exhibitor shall indemnify, defend and hold harmless WMS, its directors, officers, employees and agents, and each of them, from and against any and all claims and expenses, including attorneys’ fees and costs, arising out of or related to Exhibitor’s breach of this provision or noncompliance with any provision of the ADA.
15. Regulation Enforcement: WMS has full power to interpret and enforce all regulations of the show and the power to make amendments and/or further regulations that are considered necessary for the proper conduct of the show. Such decisions shall be binding on all exhibitors. Failure to comply with these or any other regulations or amendments may be sufficient cause for WMS to require the immediate removal of the exhibit and/or the offending exhibitor. This may result in forfeiture of all further rights to exhibit at future shows sponsored by WMS together with all fees paid. WMS may lease any space forfeited to another exhibitor. WMS reserves the right to reject any or all applications.
All matters and questions not covered by these Rules and Regulations, and interpretation of these Rules and Regulations, are subject to the decision of WMS. These Rules and Regulations may be amended and/or interpreted at any time by WMS.
